Dropping out of school?

My little cousin drake is 18 and lives in ny, he is still in his highschool but hates this school to death. He just got accepted to another school, which he loves. He will be going less than a week. drake wants to drop out because he feels he needs a break before she starts his new school, and his last school isnt helpin him. is it wrong for drake to stay home? will his dad really go to jail?
